Buller District Council - Industrial Zone Planning Rules

The below guidance is our knowledge of the rules and regulations and is provided to assist you in your assessment and early planning but does not constitute official or legal advice. 

When building an Industrial Building in Buller District there are some key rules to follow to make sure you comply with to avoid requiring a Resource Consent. 

To help you understand the requirements a brief description is noted below

PERMITTED ACTIVITIES 

Any activity in the Industrial Zone is permitted  if it falls within the standards for each category in Table 5.5. It must also comply with the District Wide rules in Part 7. 

INDUSTRIAL ZONE STANDARDS except Sergeants Hill Industrial Area

Boundaries 

Front Yards                             5 metres

Rear and Side Yards              10 metres (except where property joins another zone)

Building Height

Maximum building height is 35 metres, provided that no building shall encroach on a recession plane at an angle of 35 degrees measured from a point 2.5 metres above ground at the boundary of any Commercial or Residential Zone. 

Site Coverage

Maximum site coverage is 75%. 

SERGEANTS HILL INDUSTRIAL AREA STANDARDS

Boundaries 

Front yards                              20 metre setback from State Highway 67 and 5 metre setback from all other roads.  

Rear and side yards               Refer to INDUSTRIAL ZONE 

Building Height

Maximum building height is 20 metres

Site Coverage

Maximum site coverage is 75%. 

Concept Plan

Any industrial or commercial activity, development or subdivision in the Sergeants Hill Industrial Area shall be undertaken generally in accordance with the Concept Plan 

(shown in Part 5.2.6.7)

Other factors in Site Standards for permitted activities include

Access, blasting, esplanade strips, glare, noise, parking, planting, recession plans, service/storage areas, signs and stormwater disposal

Other rules applicable to Industrial Zones in the Buller District Plan

HAIL and Contaminated Land

From experience, XL is aware a lot of industrial land may have been developed on contaminated or HAIL land.

The Buller District Plan has rules and policies in place for contaminated land.

Carparking 

The Buller District Plan has rules and policies in place for the various Zones for car parking and landscaping. If providing car parking you will still need to comply with 

NZS 4121:2001 and provide 1 accessible car park per 1-20 spaces. 

It is also important to consider the surrounding environment and where your staff working within your new building will park if limited spaces are provided.

There are also minimum dimensions for car parks depending on the layout you choose to use on your site, along with turning circle and road width requirements. XL can work through the best car park layout for your site with you.

These are the main rules that your building needs to comply with to avoid needing a resource consent, it is important to understand there may be further rules to comply with.
