Hamilton City Council - Industrial Zone Planning Rules

The below guidance is our knowledge of the rules and regulations and is provided to assist you in your assessment and early planning but does not constitute official or legal advice.

The Hamilton City District Plan defines Industrial activities as follows:

  • All types of processing, manufacturing, service and repair activities.
  • Laboratories and research facilities.
  • Transport depots.

There are areas within the Industrial Zone that provides for Light Industrial activities:

  • Rotokauri Employment Area, Greenwood/Kahikatea Corridor and Te Rapa Corridor.

When building within an Industrial Zone in Hamilton City there are some key rules to follow to make sure you comply with to avoid requiring a Resource Consent.

 

INDUSTRIAL ZONE

Throughout the Zone the following are permitted activities provided they comply with Rules:

  • Industrial and light industrial activity.
  • Service industrial activity.
  • Ancillary office or retail activity.
  • Trade and industry training facilities.
  • Food and beverage outlets (< 250 sq. metres gross floor area).
  • Wholesale retail and trade suppliers.
  • Building improvement centres.
  • Passenger Transport facilities and transport depots.
  • Parking lots and Parking buildings.
  • Motorised recreation activity.

ROTOKAURI EMPLOYMENT AREA

The following are permitted activities provided they comply with Rules:

  • Ancillary office or retail activity.
  • Trade and industry training facilities.
  • Food and beverage outlets (< 250 sq. metres gross floor area).
  • Wholesale retail and trade suppliers.
  • Building improvement centres.
  • Passenger Transport facilities and transport depots.
  • Motorised recreation activity.

GREENWOOD / KAHIKATEA AREA and TE RAPA AREA

The following are permitted activities provided they comply with Rules:

  • Automotive and marine supplies.
  • Mowers and outdoor maintenance equipment retail.
  • Pool and spa retail.
  • equestrian supply retail.
  • Gymnasium.
  • Hire centres.

 

DEVELOPMENT STANDARDS FOR INDUSTRIAL ZONES

Building Height

20 metres except as follows:

  • 10m for that part of the building located within the Amenity Protection Area.
  • 15m where the site is in the Rotokauri Employment Area.

 

Building Height relative to boundaries

No part of a building may penetrate a height control plane rising at an angle of 45 degrees (except for the southern boundary where it is measured at 28 degrees) starting at an elevation of 3m above the boundary of any adjoining Residential, Special Character or Open Space Zones.

 

Site Coverage

Within the Amenity Protection Area or Rotokauri Employment Area: Max. 75%

Outside the Amenity Protection Area: No Maximum site coverage.

Other factors that have standards for permitted activities include Building Setbacks, Permeable Surfaces, Service and Outdoor Storage Areas

 

Other rules applicable to Industrial Zones in the Hamilton City Plan

HAIL and Contaminated Land

From experience, XL is aware a lot of industrial land may have been developed on contaminated or HAIL land.

The Hamilton City Plan may have rules and policies in place for contaminated land.

Carparking (Transport)

The Hamilton City Plan has rules and policies in place for the various Zones for car parking. Industrial Activities require 1 park per 120m2 of gross floor area along with 1 bike park per 15 FTE staff members. They require one accessible park for 3000m2 of floor area and along with 1 loading space per development or 1 per 3000m2 of floor area. There are also minimum dimensions for car parks depending on the layout you choose to use on your site, along with turning circle and road width requirements. These are the main rules that your building needs to comply with to avoid needing a resource consent, it is important to understand there may be further rules to comply with.
